Hill County officials sued over data center moratorium
Hill County officials are being sued by data center developer RCM Hill over a recently enacted year-long moratorium on data center construction. The company is seeking to strike down the pause and obtain over $100 million in damages.
The Hill County Commissioners Court recently enacted a year-long moratorium on data center construction to study potential impacts on water, power, and local infrastructure. This pause has now become the subject of a lawsuit filed by data center developer RCM Hill.
RCM Hill is suing Hill County and three members of the Commissioners Court, alleging that the company invested approximately one million dollars in preparing a large data center project near Hillsborough. The company claims these funds and secured land are now unusable due to the temporary ban.
During a special meeting, the public voiced concerns about the county's actions, with one citizen stating that public confidence is damaged when rules are waived before review. RCM Hill is asking a judge to invalidate the moratorium, prevent its enforcement, and award damages that could exceed $100 million as the legal battle continues.
