A Tompkins County Supreme Court Judge has ruled that a lawsuit challenging the Lansing Zoning Board of Appeals' (ZBA) classification of a proposed data center near the lakeshore and an adjacent wildlife preserve can proceed. The suit was filed in January by two community groups, FLX Strong and Cayuga Lake Environmental Action Now (CLEAN), against the Lansing ZBA, TeraWulf, and its subsidiaries.
The judge's decision affirms the groups' right to legally challenge the ZBA's determination that the data center project is a permissible land use. The ZBA and TeraWulf are anticipated to respond to this court ruling within the current month. Separately, TeraWulf had outlined its site plan at a Lansing Planning Board meeting on April 27.
