Federal Judge Allows NAACP Lawsuit Against Elon Musk’s xAI to Move Forward
A federal judge allowed the NAACP's environmental lawsuit against xAI and its subsidiary, MZX Tech, to proceed. The lawsuit alleges that a gas-fired power plant supplying xAI's Colossus 2 data center in Southaven operated without required Clean Air Act permits, creating pollution concerns for nearby predominantly Black communities.
U.S. District Judge Debra Brown rejected the Trump administration's effort to end the NAACP's lawsuit against xAI and MZX Tech over a gas-fired power plant serving the Colossus 2 data center in Southaven, Mississippi. Brown ruled that the Environmental Protection Agency may participate in the case but does not have authority under the Clean Air Act to unilaterally dismiss the citizen lawsuit.
The NAACP and its Mississippi State Conference allege that xAI operated dozens of methane gas turbines without required environmental permits and sought emergency court action to halt what it described as continuing unpermitted pollution. The lawsuit, backed by the Southern Environmental Law Center and Earthjustice, raises broader environmental justice concerns about air pollution and energy infrastructure near predominantly Black communities in North Mississippi and South Memphis. The ruling allows the legal challenge to continue but does not decide whether xAI violated environmental law.
