Birmingham City Councilman Josh Vasa published an opinion piece to clarify his vote on the new Data Center Ordinance, following numerous resident inquiries and concerns. Vasa, who serves as Co-Chair of the Planning and Zoning Committee, stated his 'yes' vote was not an approval for a specific project, such as the proposed Oxmoor Valley data center, which predated the Council's moratorium. Instead, the vote established a foundational citywide regulatory framework for data centers.

Vasa explained his decision to vote for the ordinance, despite public suggestions for amendments, by highlighting the critical need for immediate regulation. He noted that delaying the vote for substantive changes would have required re-advertising and a new public hearing, potentially allowing existing data centers with valid permits to expand under less oversight. He argued that implementing some regulations now was superior to having no regulations at all, acknowledging that the ordinance is a starting point that can be improved upon in future discussions, which residents are encouraged to continue shaping.
