According to the plaintiffs, the noise from the facility has become disruptively loud, with the number of turbines powering it increasing from an initial three to 69. The suit claims the noise regularly surpasses 70 dB, a level the EPA suggests is the threshold for measurable hearing loss with average daily exposure.
Attorney Ruben Diaz emphasized the legal right of long-term residents to enjoy their property and peace, stating that the industrial plant has created havoc in a quiet neighborhood. The plaintiffs are seeking damages from the court, including compensation for an alleged decrease in home values. This lawsuit follows a similar action filed by several individuals in DeSoto County in June 2026.
