California Proposition 45 would impose deadlines intended to expedite environmental reviews under CEQA for certain development projects, including projects qualifying as broadband infrastructure. Opponents warn the measure could speed approval of data centers and other polluting projects, while supporters say that concern is being used to block broader development reforms.

California Proposition 45 has become part of the debate over data center development because its eligible-project provisions cover broadband internet access, which opponents argue could encompass hyperscale and smaller data centers. The measure would establish deadlines intended to streamline reviews under the California Environmental Quality Act, a process that requires public hearings and environmental studies but has also been criticized for delaying development through lawsuits.

Supporters, including the California Chamber of Commerce, the California Building Industry Association and the California Business Roundtable, say the proposition would make it easier to build housing, infrastructure and other needed projects without eliminating environmental protections. Woody Little of Clean and Healthy California and other opponents say the measure could weaken public review for data centers and other potentially polluting facilities. USC political scientist Christian Grose said a yes vote would make data center construction easier, while a no vote would preserve existing protections. The campaign has received substantial utility and real estate industry funding, including donations from Southern California Edison, Pacific Gas and Electric Company and Prologis.
