
Texas Regulators Propose Rules for Data Center Grid Upgrade Costs
The Public Utility Commission of Texas (PUC) has proposed new rules requiring large data center customers to pay significant upfront and ongoing costs for connecting to the Texas grid, including on-site wires and substation work. Texas Governor Greg Abbott has also directed the PUC and ERCOT to audit data centers and ensure they fully fund electric infrastructure. However, a key unresolved issue is who will bear the cost for broader, off-site grid upgrades necessary to serve these power-hungry facilities.
The Texas grid faces unprecedented demand, with the governor's office reporting over 474 gigawatts of connection requests as of August 3, 90 percent of which are from data centers. In response, the Public Utility Commission of Texas (PUC) published a proposal on July 24 aimed at placing substantial payment obligations on large customers seeking this capacity.
Texas Governor Greg Abbott further intervened on August 3, directing the PUC and the Electric Reliability Council of Texas (ERCOT) to audit all data centers in the interconnection process before any projects can advance. He also instructed the PUC in June to mandate that data centers fully fund the electric infrastructure needed to serve them.
The PUC's proposal would require qualifying large-load customers, like data centers, to contract for a minimum peak demand and pay bills for at least 20 years once power is ready, regardless of actual usage. Data centers would also make upfront payments during the study phase, with partial refunds subject to deductions if they withdraw. They would directly pay for immediate connection infrastructure such as wires and substation work at their property line.
However, the proposal leaves an critical question open: who pays for broader, off-site grid upgrades—akin to highway improvements beyond a private driveway—that are identified through ERCOT's batch reviews as necessary to accommodate a data center's enormous power draw. The PUC itself has invited comments on whether to broaden the definition of transmission interconnection costs to include these larger system-wide projects, acknowledging the difficulty in assigning costs for upgrades that might also serve multiple customers or strengthen the grid generally. Comments on Project 58000 closed on August 11.
