Irvington data center decision under appeal by neighbors
Neighbors are appealing the Indianapolis Metropolitan Development Commission's approval of a DC BLOX data center in Irvington. The East Side Community Action group has hired an attorney to challenge the decision, arguing the use variance permit was inappropriate for the site. They plan to take the issue to court.
The approval for the DC BLOX data center planned for Indianapolis's east side is facing an appeal from a local community group. The East Side Community Action (ECA) group, after losing an initial battle last month when the Indianapolis Metropolitan Development Commission (MDC) approved the project at the old Ford plant in Irvington, has hired attorney Scott Federoff to challenge the decision.
ECA spokesperson Mikey Hess stated that the group is determined to continue the fight, emphasizing that the MDC's approval does not mean the issue is resolved. Attorney Scott Federoff believes the appeal has a strong chance, arguing that DC BLOX failed to demonstrate the site's appropriateness for a use variance permit under state law. He noted that neighboring properties did not require such a variance, suggesting that a legislative amendment to the zoning ordinance, rather than a use variance, would be the correct approach for introducing this land use. DC BLOX declined to comment on the matter when contacted by 13 News.
