A bipartisan Senate bill co-authored by Sen. Mike Lee would require data centers to pay the full cost of their electricity and any grid expansions needed to serve them. Creekstone Energy, developer of the $17 billion Delta Gigasite in Millard County, supports the proposal and says its project already follows that approach.

Sen. Mike Lee and other lawmakers introduced the Bipartisan American Affordability and Jobs Act of 2026, which is awaiting Senate committee votes. The proposal would prevent utilities from shifting data center electricity and grid expansion costs to residential customers or local businesses, require upfront financial guarantees for infrastructure, and allow states to mandate dedicated power generation or reduced usage during peak demand.

Creekstone Energy CEO Ray Conley and spokesperson Marty Carpenter said the company supports the bill because it would provide investment certainty and align with plans for its Delta Gigasite. Creekstone is developing the site and associated power infrastructure, using natural gas generation, solar and storage while evaluating possible nuclear additions. The company describes the project as a $17 billion data center campus in Millard County.
