Vermillion Planning Commission Considers Data Center Moratorium and Ordinances
The City of Vermillion's Planning and Zoning Commission held a public hearing on proposed ordinances for data centers and a potential one-year moratorium. Numerous residents attended, expressing concerns about water and electrical usage, environmental impacts, and quality of life. No action was taken at the adjourned meeting, which will resume on August 31.
The Vermillion Planning and Zoning (P&Z) Commission convened a public hearing regarding six proposed ordinances concerning data centers and a potential one-year moratorium. The meeting, moved to the city council chambers due to high public interest, saw a packed room of nearly a dozen residents urging a moratorium on new data center developments.
Public comments highlighted a range of concerns, including data centers' substantial water and electrical consumption, their impact on local quality of life, environmental issues, and the potential disturbance to livestock, pets, and wildlife. Vermillion attorney Caitlin Collier, a former state legislator, also raised legal questions, suggesting the proposed city ordinances might conflict with South Dakota's recently enacted data center bill of rights, particularly regarding definitions based on acreage versus power usage.
City Engineer Jose Dominguez informed attendees that while the city has been approached by data center companies, no projects have materialized. He explained that current ordinances lack specific provisions for data centers, potentially allowing them under broad definitions like 'retail services and trade,' making it difficult for the public to appeal without specific regulations. The proposed ordinances aim to create a distinct category for data centers, setting specific rules for buffers, water for cooling, noise, and limiting their size to prevent large-scale consolidated operations.
No official action was taken by the P&Z Commission at the meeting, which was adjourned due to a scheduling conflict and will resume on August 31. The P&Z Commission's role is to make recommendations to the Vermillion City Council for final decisions. Residents are also invited to an informational meeting on August 18 at the Vermillion Public Library to hear from local experts on data centers.
