Under the new directives, data center developers are now required to submit detailed plans to the Energy and Environment Cabinet, outlining their power needs and any potential adverse effects on residential ratepayers. The Cabinet has been explicitly instructed to reject any applications that pose a risk of polluting land, water, or other natural resources. Additionally, the order prohibits state regulators from increasing utility rates to offset costs associated with data center operations. Data centers will also face stricter requirements for paying state and local taxes, alongside demands for greater transparency in their operations. Governor Beshear emphasized that companies seeking to establish operations in Kentucky must demonstrate a commitment to being responsible partners within their communities. The order, however, does not interfere with data center decisions made at the local government level.
