The City of Colorado Springs has confirmed the receipt of five appeals challenging the administrative approval of a data center project located on Garden of the Gods Road. One of these appeals, a 200-page document provided to News5, cites seven grounds for overturning the decision.

Key arguments within the appeals include claims that the project was approved by the wrong decision-makers, that criteria for a minor modification were incorrectly applied to a major project, and that findings regarding noise compliance are flawed. Additionally, the appeals allege an understatement of the data center's electrical load usage. The developer maintains that the plan for repurposing a building in an existing tech-zoned area meets all city code and zoning requirements, while concerned neighbors are actively opposing the project.

City Planning Director Kevin Walker stated that the city is currently verifying the eligibility of the appeal applicants, ensuring they reside within the allowed radius. If all appeals qualify, they will be forwarded to the planning commission to assess their validity and determine if the initial application approval should be overturned. If one or more appeals are approved, a planning commission hearing must be scheduled within seven days.
