The NAACP has initiated legal action against Elon Musk's xAI, filing a lawsuit in federal court on Tuesday. The civil rights organization alleges that xAI is illegally operating 27 methane gas turbines in Southaven, Mississippi, to power its Colossus 2 data center complex situated across the state line in Memphis, Tennessee. The lawsuit, lodged in the U.S. District Court for the Northern District of Mississippi, contends that emissions from these gas turbines contravene the Clean Air Act, posing substantial health risks to local communities. According to the NAACP, which is represented by Earthjustice and the Southern Environmental Law Center, xAI and its subsidiary MZX Tech operated the turbines between August and December without the required air permits. Abre' Conner, NAACP director of environmental and climate justice, criticized the company for "looking to evade clean air laws" and "asking Black and frontline communities to bear the toxic brunt of ‘innovation.'" The plaintiffs assert that the turbines emit pollutants such as formaldehyde and nitrogen oxides, impacting predominantly Black communities already facing industrial pollution burdens. They claim the Colossus 2 site could annually emit over 1,700 tons of nitrogen oxides, potentially making it the largest industrial source of this pollutant in the 11-county Memphis metropolitan area. This legal challenge follows a previous dispute in 2025 regarding xAI's operation of gas turbines for its Colossus 1 data center without permits. In 2024, Mississippi and Tennessee officials had reportedly allowed xAI to operate "temporary" and "mobile" turbines without permits, an exemption that required no official tracking of toxic releases. xAI eventually removed some turbines and obtained permits for others at the Colossus 1 site after a notice of intent to sue from the NAACP and Southern Environmental Law Center in June 2025. In response to the current lawsuit, xAI affirmed its commitment to environmental standards, stating, "The temporary power generation units are operating in compliance with all applicable laws." The lawsuit seeks to halt xAI's operations until the company secures necessary permits, implements effective pollution controls, and pays financial penalties for past air quality violations. The Colossus 2 data center is designed to host 555,000 Nvidia GPUs and could require up to 2 gigawatts of power, with xAI deploying industrial batteries to manage the load.
