The humane society is worried about low and high frequencies produced by the industrial-scale facility and its effect on a planned new hospital.
The Greater Birmingham Humane Society (GBHS) has initiated a lawsuit against Nebius, a company developing an AI data center adjacent to its property in Birmingham, Alabama. The lawsuit, filed in Jefferson County Circuit Court, cites a lack of transparency and information from Nebius regarding the potential effects of the industrial-scale facility on the animals in the humane society's care.
GBHS President and CEO Allison Black Cornelius expressed concerns about low and high frequencies emitted by the data center, noting animals' sensitivity to such ranges. The organization also reported that uncertainty surrounding the project has negatively impacted fundraising for a new animal hospital planned for an adjacent parcel. Cornelius stated that efforts to communicate with Nebius proved fruitless, leading to the legal action.
The lawsuit aims to compel Nebius to provide answers regarding the project's impact and to ensure the development received proper legal approvals. Both Nebius and the city of Birmingham have declined to comment on the pending litigation. This legal battle follows a separate ruling allowing a lawsuit filed by Oxmoor Valley neighbors against the same project to proceed.
