Hochul pauses data center development
New York Gov. Kathy Hochul has enacted the nation's first data center moratorium through an executive order. The one-year pause halts new permit approvals for data center projects requiring over 50 megawatts of power. During this time, state agencies will develop a comprehensive regulatory framework for these projects.
New York Governor Kathy Hochul on Tuesday signed an executive order enacting a one-year moratorium on new data center permit approvals across the state. This action marks the nation's first data center moratorium, specifically targeting projects that intend to use more than 50 megawatts of power at any given time.
The Governor's office stated in a press release and briefing that the pause is intended to allow state agencies to develop a comprehensive regulatory framework for data center projects. During this year-long period, regulatory bodies will be required to halt new permit approvals for qualifying data center developments.
