The court order specifically stays an emergency drilling authorization from October 23, 2025, that permitted Santa Teresa Capital, LLC, to utilize water from the well for its data center project.
This legal action stems from a challenge filed by the Center for Biological Diversity against Elizabeth Anderson, in her capacity as New Mexico State Engineer, and Santa Teresa Capital, LLC. The environmental group had filed an emergency petition, arguing that the approval of the replacement well failed to meet state requirements for emergency authorization, particularly regarding public notice and a hearing. The organization previously stated that over 103 million gallons of freshwater had already been pumped from the well since April. The Supreme Court has mandated that a response in the case be filed by September 2.
