Smithfield approved an ordinance banning data centers after town officials learned that a developer was considering a business park that would include a data center. Town Council member Rachel Topp said most residents and council members did not believe a data center was an appropriate fit for Smithfield. The developer’s application was certified incomplete twice, and the matter was continued before the Board of Appeals.

Canton City Investments in Our OK LLC has filed two lawsuits against the town. One argues that the moratorium ordinance was enacted after the application was submitted, while the other challenges the town’s issuance of certificates declaring the project application incomplete. The developer said it still hopes to work with town officials on an industrial park, arguing that the project could provide financial benefits and help stabilize electricity prices.
