The fight over a controversial data center project in Cumberland County, Pennsylvania, has escalated to the courts. Residents from Middlesex Township are seeking to stop ongoing construction of a facility referred to as "Packs One," arguing that it is proceeding despite a lack of final approval.
At a court hearing, Judge Matthew Smith heard arguments from both the developer's lawyers and the opponents. The developer's representatives asserted that final approval should be nearly automatic following preliminary approval. However, opponents countered that they did not appeal the preliminary approval sooner because the process was conducted "secretly," leaving them unaware of key developments.
Opponents also raised concerns about the environmental impact on the Susquehanna River and the aesthetic impact on the Appalachian Trail, which is near the site. Furthermore, they alleged a conflict of interest involving an environmental review consultant who also works for the developer, a suggestion the developer's lawyers called "slanderous." The judge is now reviewing 21,000 pages of documents, and a decision timeline is not yet official.
