A Fulton County resident has filed a lawsuit against the Fulton County Area Plan Commission and Data Center Ordinance Review Committee, alleging violations of Indiana's Open Door Law regarding public meetings. The lawsuit comes after county commissioners approved a one-year data center moratorium in March, which led to the formation of the review committee.

A Fulton County resident has initiated legal action against the Fulton County Area Plan Commission and the Data Center Ordinance Review Committee, citing alleged non-compliance with Indiana's Open Door Law. The lawsuit, filed by a resident identified as O'Neill, claims the public is unable to attend or listen in on the committee's meetings, which were formed to review data center regulations. This legal challenge follows the county commissioners' 2-1 vote in March to approve a one-year data center moratorium, prompted by discussions of a potential data center project in Akron. The data center review committee was subsequently established to examine existing regulations and practices in other communities. The committee, however, asserts that it is not obligated to follow the Open Door Law, arguing it does not qualify as a "governing body." A court date for the case is pending the appointment of a new judge.
