Broken Bow City Council Proposes Ordinance to Regulate Data Centers
The Broken Bow City Council held a meeting where they discussed and heard the first reading of a comprehensive ordinance (Ordinance 1317) to regulate data center construction and operation within city limits. The proposed rules include stringent requirements for noise, water, electric usage, financial bonds for decommissioning, and disclosure of ownership. The council plans to continue public comment on the ordinance.
On Tuesday, August 11, the Broken Bow City Council held a regular session where they heard the first reading of Ordinance 1317, a comprehensive measure designed to strictly regulate data center construction and operation within city limits. Zoning Administrator Jacob Holcomb presented an updated version of the ordinance, which had previously been reviewed by the Planning Commission on June 30.
The proposed ordinance outlines stringent requirements for data center developers. These include mandatory pre-development noise studies with strict limits on sound emissions, followed by ongoing post-construction noise audits. It also imposes close regulation on water and electric usage. Companies proposing data centers will be required to cover 100% of any necessary municipal infrastructure upgrades, post a bond equivalent to 150% of anticipated decommissioning costs, and undergo criminal background checks for major owners while disclosing any foreign ownership or control.
Mayor Rod Sonnichsen and Holcomb emphasized the ordinance's importance in protecting citizens and municipal infrastructure, with Holcomb noting its potential as a template for other communities. The council decided to continue receiving public comment on the proposed ordinance at future meetings, indicating the regulatory process is ongoing.
