Charlotte County Commission Considers Prohibiting Data Centers

The Charlotte County Commission in Florida is actively considering prohibiting data center development due to concerns over energy and water consumption, as well as noise. Following a new state law granting local regulatory authority, the commission directed staff to prepare proposed comprehensive plan amendments and ordinances to ban data center construction in the county.

The Florida Legislature recently passed a new state law, F.S. 163.326, which empowers local governments to regulate data center development. This legislative action prompted the Charlotte County Commission to hold a workshop to discuss the implications of data centers, a topic that has generated both economic interest and environmental concerns regarding their massive energy and water consumption, as well as noise generation.

During the workshop, Charlotte County's planning and zoning official suggested that existing county land use policies might already preclude data center construction. However, both the official and the county attorney advised that such a determination could be subject to appeal, potentially challenging the county's stance before the Board of Zoning Appeals or in court. This possibility raised concerns among commissioners about their ability to control future data center projects.

Following a robust discussion, the Charlotte County Commission reached a consensus that the county is not an appropriate location for data centers. Consequently, the board instructed the Community Development Department and the County Attorney’s Office to research the issue further and to draft proposed amendments to the comprehensive plan and/or new ordinances that would explicitly prohibit data center construction within Charlotte County. The commission plans to revisit the issue in future meetings.
