The NAACP, represented by Earthjustice and the Southern Environmental Law Center, filed a lawsuit in the U.S. District Court for the Northern District of Mississippi against Elon Musk's xAI and its subsidiary MZX Tech on Tuesday. The lawsuit alleges that xAI is illegally operating 27 methane gas turbines in Southaven, Mississippi, to power its Colossus 2 data center complex located across the state line in Memphis, Tennessee. The civil rights organization contends that these gas turbines, intended for xAI's Grok-4 chatbot training facility, have been operating without an air permit and are emitting pollutants like formaldehyde and nitrogen oxides, in violation of the Clean Air Act.
According to the NAACP, these emissions pose significant health and safety risks to predominantly Black communities in northern Mississippi and the Memphis metropolitan area, which are already burdened by industrial pollution. The lawsuit aims to halt xAI's operations until the company obtains necessary permits, installs effective pollution controls, and pays financial penalties for past air quality violations. The Southern Environmental Law Center emphasized that major pollution sources are required to obtain air permits before construction or operation, a requirement xAI allegedly evaded by classifying its turbines as "temporary" and "mobile." The NAACP states that the turbines could emit over 1,700 tons of nitrogen oxides annually, potentially making it the largest industrial source in the 11-county Memphis metropolitan area.
xAI responded to the legal action, stating its commitment to environmental standards and asserting that "The temporary power generation units are operating in compliance with all applicable laws." This current lawsuit follows a similar legal dispute in 2025 regarding xAI's Colossus 1 data center, where xAI eventually removed turbines and obtained permits after the NAACP issued a formal notice of intent to sue. The Colossus 2 data center is planned to host 555,000 Nvidia GPUs and could require up to 2 gigawatts of generation capacity, with xAI having deployed 600 industrial-grade batteries for energy management.
