The Justice Department has moved to intervene and dismiss a civil rights lawsuit filed against xAI, an Elon Musk-owned company, regarding its $20 billion data center in Mississippi. The lawsuit, initiated by the NAACP and other environmental groups, alleges that xAI is illegally operating dozens of natural gas turbines without proper permits, leading to air pollution that violates the federal Clean Air Act and endangers communities in North Mississippi and nearby Memphis.

Associate Attorney General Stanley Woodward stated that the Justice Department's intervention aims to protect national security and promote American energy and innovation, asserting that the AI data center is "critical to the economy" and the U.S. military. The department also argued that the state of Mississippi is responsible for permitting and had determined no permit was required, and that ultimate enforcement of federal law rests with the Executive Branch, not private interest groups.

Environmental law firm Earthjustice, representing the NAACP and Southern Environmental Law Center, criticized the Justice Department's action as a "desperate attempt to protect wealthy tech companies from obeying the laws meant to protect people from pollution." Abre' Conner, the NAACP's director of environmental and climate justice, emphasized that the Clean Air Act is designed to hold polluters accountable and that citizen suits are a vital mechanism for enforcement. The data center's pollution, according to critics, is turning communities into "sacrifice zones."

This development comes amidst the Trump administration's focus on AI as a national security priority and its efforts to roll back environmental regulations. Elon Musk has close ties to the Trump administration, and his company SpaceX, the parent of xAI, recently had a significant IPO. SpaceX has previously stated it is in full compliance with the law and takes its environmental responsibilities seriously.
