
Landowners challenge Emporia’s data center zoning approvals
Three landowners sued the City of Emporia over zoning approvals for a digital infrastructure overlay district and related rezoning of 11 tracts. They allege the city acted before the overlay ordinance took effect and used development agreements without adequate standards or public input.
Three landowners filed a lawsuit in Lyon County District Court challenging Emporia’s approval of a Digital Infrastructure Overlay District and the rezoning of 11 tracts. The plaintiffs contend the Emporia City Commission acted two days before the overlay ordinance took effect and that the rezoning applications did not satisfy city requirements.
The lawsuit also challenges the city’s use of development agreements for future digital infrastructure projects, arguing the agreements lack sufficient standards and bypass the normal zoning review process. The challenged approvals were described by city planning staff as an initial step toward potential development, not approval of a specific data center project; no end user had been identified. The city received an extension until Oct. 8 to respond, and no ruling on the merits had been issued.
