Chesterfield's Board of Zoning Appeals upheld a planning director's denial of a proposed data center in the Bermuda District. The property owner, Washington Single Family Fund, appealed the decision, but the board refused to acknowledge it, citing a new ordinance and lack of vested rights. The project could still proceed by going before the Board of Supervisors.

The Chesterfield Board of Zoning Appeals upheld a planning director's decision to deny a proposed data center in the Bermuda District on Wednesday.

Washington Single Family Fund, the property owner, appealed the denial, arguing that the planning director did not have the authority to issue zoning determinations. However, the county contended that the planning director still oversees zoning and that the company lacked "vested rights" because no approved site plan was in place before new zoning rules took effect on January 1, 2026. Attorney Clark Leming represented the company, while Chesterfield county attorney Andrew J. Fulwider represented the county's position.

About a dozen community members attended the meeting to voice their opposition to data centers. With the denial upheld, the proposed project would now need to be presented to the Chesterfield Board of Supervisors, indicating that the potential for a data center in the area remains.
