The New Mexico Supreme Court has denied two challenges brought by environmental advocacy groups against the permitting processes for Project Jupiter, a large data center currently under construction in Doña Ana County. The court's decision, issued Thursday, also lifted pauses that had been placed on these proceedings last month.
This ruling clears the way for permits related to water use and air quality for the data center to move forward. Furthermore, it allows the construction project to resume drawing water from a well located on the site.
Environmental groups, specifically The Center for Biological Diversity and New Energy Economy, had petitioned the court to intervene in the permitting processes. They argued that there was a lack of due process in the proceedings. The high court reviewed briefs and responses from all parties before concurring on the denial of both petitions.
